Media Waiver

Please note that the SUN ’n FUN Media Waiver applies to media credentials only. It does not satisfy or replace any additional waivers that may be required to enter restricted or authorized areas during the Expo. Access to these areas requires separate approval and authorization from the appropriate event representatives.

As a condition of receiving media credentials for the 53rd Annual SUN ’n FUN Aerospace Expo (hereinafter referred to as the “Activity”), I, together with my custodial parent or guardian if I am under the age of eighteen or under a legal disability, represent, covenant, and agree on behalf of myself, my heirs, assigns, and any other person claiming by, under, or through me, as follows:

  1. I understand and agree that SUN ’n FUN Fly-In, Inc. (SnF, Inc.) owns all trademarks, copyrights, and other proprietary rights connected to SnF, Inc. and retains all worldwide rights. Any broadcast, rebroadcast, or use of accounts, pictures, or descriptions of events—except news broadcasts by legitimately accredited and credentialed news media—is prohibited without the express written permission of SnF, Inc. All SnF, Inc. events, including the annual SUN ’n FUN Aerospace Expo, are proprietary to SnF, Inc. Attendance at or exhibition during these events is subject to SnF, Inc. policies and requirements, as well as all applicable laws. Rights may also have been granted to national and international broadcast, cable, and satellite services, and additional restrictions imposed by those services may apply. I have read the SnF, Inc. Media Guidelines and Policy in its entirety and agree to comply with that policy as a condition of receiving media credentials.

  2. I acknowledge that participation in the Activity involves certain risks, some of which I may not fully appreciate, and that injury, death, property damage, or other harm could occur to me or others. I accept and voluntarily incur all risks of injury, damage, or harm arising during or resulting from my participation in the Activity, regardless of whether caused in whole or in part by the negligence or other fault of SnF, Inc.; Aerospace Center for Excellence, Inc. (ACE, Inc.); and/or their departments, affiliates, employees, trustees, officers, agents, or insurers (hereinafter referred to as the “Released Parties”).
  3. I waive all claims against any of the Released Parties for injuries, damages, losses, or claims, whether known or unknown, arising during or resulting from my participation in the Activity, regardless of whether caused in whole or in part by the negligence or other fault of any of the Released Parties. I release and forever discharge the Released Parties from all such claims.
  4. I agree to indemnify and hold the Released Parties harmless from all losses, liabilities, damages, costs, or expenses—including, but not limited to, reasonable attorneys’ fees and other litigation costs and expenses—incurred by any of the Released Parties as a result of claims or suits that I, or anyone claiming by, under, or through me, may bring against any of the Released Parties to recover losses, liabilities, costs, damages, or expenses arising during or resulting from my participation in the Activity, regardless of whether caused in whole or in part by the negligence or other fault of any of the Released Parties.

I have carefully read and reviewed this Agreement, Waiver, Release and Hold Harmless Statement. I fully understand it and execute it voluntarily.

Media Guidelines

Broadcast, Film | Video

SUN ’n FUN Fly-In, Inc. (SnF, Inc.) owns all trademarks, copyrights, and other proprietary rights connected to the SUN ’n FUN Aerospace Expo and retains all worldwide rights. Any broadcast, rebroadcast, or use of accounts, pictures, or descriptions of SUN ’n FUN—with the exception of news broadcasts by legitimately accredited and credentialed news media—is prohibited without the express written permission of SnF, Inc. All SnF, Inc. events, including the annual SUN ’n FUN Aerospace Expo, are proprietary to SnF, Inc. Attendance at or exhibition during these events is subject to SnF, Inc. policies and requirements, as well as all applicable laws. Rights may have been granted to national and international broadcast, cable, and satellite services, and additional restrictions imposed by those services may also apply.

This policy applies to any and all Recordings, including broadcasts, moving and still images, sound, and other recordings, regardless of the method of capture or storage, including film, digital, video, or other formats or media. The policy applies to activities throughout the entire SnF, Inc. campus and event area, including, but not limited to: all activities which may take place within the entire SnF, Inc. campus and event area, to include, but not limited to: flight line areas, the Florida Air Museum, SUN ’n FUN campground, Sunset Grill, Media Center, Paradise City, Davis Education Center, Buehler Restoration Center, Hospitality Center and The Pavilion.

Television stations, networks, cable systems, and other media outlets may not make Recordings available to another organization without advance written permission from SnF, Inc.

General Commercial News Media

SUN ’n FUN Fly-In, Inc. (SnF, Inc.) owns all trademarks, copyrights, and other proprietary rights connected to the SUN ’n FUN Aerospace Expo and retains all worldwide rights. Any broadcast, rebroadcast, or use of accounts, pictures, or descriptions of SUN ’n FUN—with the exception of news broadcasts by legitimately accredited and credentialed news media—is prohibited without the express written permission of SnF, Inc. All SnF, Inc. events, including the annual SUN ’n FUN Aerospace Expo, are proprietary to SnF, Inc. Attendance at or exhibition during these events is subject to SnF, Inc. policies and requirements, as well as all applicable laws. Rights may have been granted to national and international broadcast, cable, and satellite services, and additional restrictions imposed by those services may also apply.

  • Refer to the SUN ’n FUN Guidelines for Copyright/Media/Trademark Policy.
  • SUN ’n FUN is the only authorized library for SUN ’n FUN Recordings.
  • No commercial entity may maintain or service a film or videotape library containing SUN ’n FUN footage unless specifically authorized in writing by SUN ’n FUN.
  • No individual or commercial entity may intercept and/or record any video feed or satellite transmission used to distribute coverage of a SUN ’n FUN event to authorized broadcast and cable networks or other authorized users without the express written consent of SUN ’n FUN.
  • No commercial entity may make any Recording of any SUN ’n FUN event or activity, including the annual SUN ’n FUN Aerospace Expo, without the express written permission of SUN ’n FUN. Every approved broadcaster’s camera operator, whether commercial or news media, must display the access sticker issued by SUN ’n FUN. Video or film camera operators who do not display the appropriate access credential will be escorted from the grounds. Violators may also be denied access to future SUN ’n FUN events, and legal action may follow.
  • Video recorded using home-style cameras is restricted to personal use. Commercial or other use without the express written consent of SUN ’n FUN is strictly prohibited. This includes selling footage obtained on SUN ’n FUN grounds to a broadcast entity or any other entity.
  • No commercial entity—except legitimately accredited and credentialed media operating under the Broadcast/News Media Guidelines outlined in this policy—may rebroadcast, retransmit, supply, sell, or resell video material from any SUN ’n FUN event, including the annual SUN ’n FUN Aerospace Expo, without the express written consent of SUN ’n FUN.
  • Video material obtained from any SUN ’n FUN event may only be used as permitted by this policy or as specified in an applicable Licensing Agreement obtained from SUN ’n FUN.
  • “Non-linear” use of SUN ’n FUN content is prohibited without express prior written permission from SUN ’n FUN. This includes, but is not limited to, archived television content on the Internet, television content available through video-on-demand, and television content made available through PVR downloads. This restriction also includes images distributed through cellular services, personal communications services, other methods of providing content to handheld digital devices, specialized mobile radio, and wireless Internet, including WiFi.

Broadcast/News Media Guidelines

  • Only legitimately accredited and SUN ’n FUN-credentialed Broadcast and Film News Media may broadcast, rebroadcast, or cablecast video material obtained at a SUN ’n FUN event.
  • All legitimately accredited and credentialed Broadcast and Film News Media must comply with the SUN ’n FUN Guidelines for Television Crews, including all SUN ’n FUN grounds-access requirements described in this policy.
  • Use of Recordings obtained from any SUN ’n FUN event is limited to five minutes and must occur within 48 hours after the close of the event, unless otherwise authorized by SUN ’n FUN.
  • All SUN ’n FUN event Recordings obtained from SUN ’n FUN must include the appropriate video credit: “Courtesy of SUN ’n FUN Aerospace Expo.”

Guidelines for Television/Video Crews

  • Television crews must follow the directions of SUN ’n FUN officials at all times. If clarification is needed, contact the SUN ’n FUN Marketing Department.
  • Television crews must remain behind the established crowd line at all times while filming the airshow or other aerial activities.
  • Individuals and vehicles of any type are not permitted beyond the crowd line without authorization from SUN ’n FUN. Media representatives who require access beyond the crowd line to perform their work should contact the SUN ’n FUN Marketing Department through the onsite SUN ’n FUN Media Center to request additional permission. The SUN ’n FUN Media Department works with SUN ’n FUN Air OpeAnyone who goes beyond the crowd line without proper authorization will be escorted off the field, and access to future events may be denied and/or limited.rations to coordinate additional permissions for access beyond the crowd line.
  • Safety is the primary consideration in decisions made by SUN ’n FUN when directing television crews and other media representatives on the grounds. Other factors may also influence access decisions established by SUN ’n FUN officials.

Live Video Streaming / Web Streaming Policy

  • SnF, Inc. allows accredited media organizations to distribute online video content live from the SUN ’n FUN grounds, including interviews and news conferences, subject to the requirements below. The SUN ’n FUN grounds are considered property owned and/or leased by SnF, Inc. for the SUN ’n FUN event. Live distribution must therefore comply with the following policy:
  • Live web streaming is permitted provided SnF, Inc. has not entered into a contract granting exclusive live coverage from the grounds during SUN ’n FUN. If an outlet has been granted exclusive live web-streaming rights by contract, all other live web streams are prohibited during the event.
  • All live web-streaming requests must receive written approval from SnF, Inc. before arrival and setup at SUN ’n FUN.
  • Live web streaming by non-SUN ’n FUN entities may take place only from a single studio location, such as a media trailer or adjacent set, news conference area, exhibitor location, or similar approved location. Roving live web streams and live webcams are not permitted.
  • Live web streams from the generally established airshow flight line, crowd line, or event areas are not permitted except through an express written agreement with SnF, Inc. Every live web stream must include a SUN ’n FUN-provided open and close, which must be run with each individual web-stream unit.
  • An entity providing a live web stream from the SUN ’n FUN grounds must provide a minimum 15-minute interview with a designated SUN ’n FUN representative for each day it conducts a live web stream from the grounds.
  • Any wireless technology used to create and/or distribute a live web stream must be approved by SUN ’n FUN to ensure frequencies do not interfere with those used for aircraft operations and safety or frequencies already in use as part of SUN ’n FUN’s infrastructure.
  • Live web streams must appear in an editorial context only. Sponsorship, merchandising, or advertising may not be integrated with or around the content.
  • SnF, Inc. may link, without charge or obligation, to any posted web stream originating from the SUN ’n FUN grounds for as long as that content remains available online or as part of an online video archive.
  • SnF, Inc. reserves the right to update this policy at any time and without advance notice.

Acceptance of your media credential confirms that you acknowledge, understand, and accept the SUN ’n FUN Fly-In, Inc. Media Guidelines and Policies outlined above. Acceptance of these policies is a specific condition of admission to the SUN ’n FUN event. Violation of these policies may result in exclusion from the SUN ’n FUN grounds and/or the annual SUN ’n FUN event and may also result in fines and/or criminal or civil prosecution.

SUN’n FUN Copyright / Media / Trademark Policy

The SUN ’n FUN Aerospace Expo recognizes that guests and aviation enthusiasts enjoy capturing the excitement of SUN ’n FUN through Recordings, including still and moving images, sound, and other media. SUN ’n FUN therefore permits attendees to make Recordings—regardless of the method of capture or storage, including film, digital, video, or other formats or media—for personal use only.

SUN ’n FUN has made a substantial investment in creating and producing the SUN ’n FUN Aerospace Expo and has an ongoing interest in protecting the intellectual property rights associated with the event.

As the creator and producer of the SUN ’n FUN Aerospace Expo, SUN ’n FUN retains all worldwide rights to SUN ’n FUN and to Recordings made at or of SUN ’n FUN, whether captured on or off SUN ’n FUN grounds.

SUN ’n FUN is the sole owner of trademarks, copyrights, and other proprietary rights connected with SUN ’n FUN, Aerospace Center for Excellence, the Florida Air Museum, and any SUN ’n FUN event.

Event and organization names may be used for news purposes and consistent with the First Amendment. Nothing in these terms and conditions authorizes or permits the violation of SUN ’n FUN trademarks, copyrights, or other proprietary rights.

The sale or use of any Recording of any aspect or activity connected with SUN ’n FUN—including, but not limited to, aircraft, crowds, airshows, forums, and exhibits—for commercial purposes without SUN ’n FUN’s written permission is strictly prohibited. This restriction applies both during the event and on a continuing, perpetual basis unless expressly permitted through a written agreement with SUN ’n FUN.

This prohibition includes, but is not limited to, “non-linear” uses, including archived television content on the Internet, television content available through video-on-demand, and television content made available through PVR downloads without express prior written permission from SUN ’n FUN. It also applies to images distributed through cellular services, personal communications services, other methods of delivering content to handheld digital devices, specialized mobile radio, and wireless Internet, including WiFi.

Legitimate media representatives seeking to cover SUN ’n FUN events must first obtain SUN ’n FUN accreditation. Accreditation is granted at SUN ’n FUN’s discretion. Any Recordings made under that accreditation may be used only by the publication or publications the media representative officially represents and only for the purposes stated in the accreditation request. Accreditation and permissions are not assignable or transferable. Use of Recordings or accounts by another publication, or for purposes other than those approved, is prohibited unless that publication obtains additional written permission from SUN ’n FUN. Recordings intended for photo or video stock houses are also prohibited unless prior written permission has been obtained from SUN ’n FUN.

This policy also prohibits using SUN ’n FUN Recordings, trademarks, and trade names for secondary promotional purposes, including promotional portfolios, websites, and other settings that endorse a specific photographer or company, unless written permission is obtained in advance.

Trademark Policy

Use of any SUN ’n FUN trademark or trade name without express written permission is strictly prohibited in any manner, form, or context, whether commercial or private. This applies regardless of whether the item or use is sold, worn by employees, given away, or otherwise distributed at no cost.

SUN ’n FUN reserves the right to enforce its rights against any person or entity violating the SUN ’n FUN Copyright/Media and Trademark Policy, particularly those who attempt to sell Recordings or use SUN ’n FUN trademarks or trade names commercially without express written permission. Violators are subject to all available remedies under United States and international law, up to and including injunctive relief.

Use of SUN ’n FUN-related logos, words, graphics, designs, photographs—film or digital—and/or any other images that depict or reference the annual SUN ’n FUN convention/fly-in, including uses that commemorate, denote, reference, or otherwise associate with the SUN ’n FUN convention/fly-in, is prohibited without prior written consent from SUN ’n FUN. This includes, without limitation: products or services, commercial uses, giveaways, advertising, promotions, endorsements, sales, rentals and displays.

Any use, attempted use, or registration of a trademark or trade name that is similar or confusingly similar to the marks listed in Appendix A is strictly prohibited. SUN ’n FUN reserves the right to amend and update this policy and Appendix A at any time.
